Uber driver is suing his passenger who agreed to drive his car so that he can take a nap in the back seat

An Uber driver is suing his passenger and his bosses after the customer took the wheels of his car and led police on a high speed chase. 43-year-old Corey Robinson, who worked as a part time Uber driver and a part time plumber, was hired to drive a man from Philadelphia, Pennsylvania, to the Bronx in New York City.  During the trip, Robinson became tired and asked his passenger, 20-year-old Juan Carlos, who does not have a driver’s license, to drive. At about 5:30 a.m., Robinson took a nap in the back seat of the car, while Carlos drove the vehicle.
According to the lawsuit, New York State Troopers spotted Robinson’s 2016 Hyundai Sonata doing 86 miles per hour in a 65 mph zone. The officers tried to pull over the vehicle, but Carlos sped off and he refused to stop. Robinson awoke to the commotion and when he realized what was happening, he ordered Carlos to pull over, but he refused. Carlos eventually lost control of the car and crashed into a guardrail, and the vehicle was totalled.
Carlos was arrested for driving without a license along with several traffic violations, including unlawfully fleeing a police officer.
In his lawsuit, which was filed in the Bronx Supreme Court, Robinson said that when Carlos agreed to take the wheel, he effectively became a “servant or agent” of Uber, and therefore, they are also responsible to pay for the damages. Robinson is seeking an unspecified amount in damages.
